Valuation list for non-commercial imports and its general notes for the interpretation of the General Customs of the Republic of Cuba.

The year 2022 marked an important change in Cuba's customs regulations, as Resolutions 206 and 207 of 2014 governing non-commercial imports were repealed. In their place, Resolution 175 of July 23, 2022, issued by the Chief of Customs of the Republic of Cuba, was instated, which establishes the new regulations for non-commercial imports by natural persons.

In addition, Resolution 176/2022 of the Head of Customs itself was issued, which establishes the methods for the determination of customs duties for miscellaneous shipments destined to individuals, and Resolution 204/2022 of the Ministry of Finance and Prices, which sets the tariff rate for individuals receiving air, maritime, postal and courier shipments of a non-commercial nature.

As for the determination of the value at Customs, it is maintained through one of the following methods: the Customs Declaration, the purchase invoice, the reference value determined by Customs or the value-weight alternative used to value the miscellaneous.

Among the substantial modifications that have been made for non-commercial imports by natural persons are changes in import quantities and values, the new Quantity/Value Table 2022, modifications in the importation of unmanned aircraft, updates in the regulations for the importation of food of animal origin and medicines.

On the other hand, for commercial imports made by legal entities, the Customs Commercial Tariff was modified according to the Harmonized System of Classification of Products (SACLAP 2022). However, this measure only applies to commercial imports authorized for legal entities, such as companies, organizations, MSMEs and institutes. Natural persons may only carry out non-commercial imports, regulated by Resolutions 175 and 176 of 2022 of the Head of Customs of Cuba.

CUBA CUSTOMS VALUATION LIST 2024

CHAPTER 1- MISCELLANEOUS

In accordance with the legal provisions, footwear, clothing, food, personal and household hygiene items, jewelry, perfumery and similar items are classified as miscellaneous for import purposes. This means that in order to import these products, they must be diverse in type.

That is to say, the importation of large quantities of a single type of product of the same category will not be allowed, for example, one hundred pairs of identical shoes may not be imported, but the models and designs must vary.

CHAPTER 2- PHOTOGRAPHIC AND CINEMATOGRAPHIC PRODUCTS

The value-weight alternative applies to the valuation of photographic products whose value is less than $50.00 USD. This means that instead of using the purchase invoice or any other method to determine their value, their weight will be taken into account to set the corresponding tariff.

CHAPTER 3- PAINTS, VARNISHES AND HOUSEHOLD AND HARDWARE ARTICLES

Customs has established specific regulations for the importation of household goods and hardware. First, for those products that are not durable or that being durable do not have a representative value, the value-weight alternative is used. This modality also applies to items such as water batteries, flashlight batteries, switches, sockets and the like.

In addition, Customs allows the importation of up to five (5) articles of each type that classify as hardware, as long as their value does not exceed fifty (50.00) USD. In the case of those that exceed that value, including those that constitute sets, up to three (3) articles are admitted, in all cases in correspondence with the established import limit.

For paints, varnishes, pigments and diluents, importation is allowed as long as the total sum of the contents of their containers does not exceed twenty (20) liters, regardless of the format of the container.

For electric cables and wires, up to three (3) reels or spools of up to one hundred (100) meters each are allowed. For hoses, intended for gardening, scrubbing or other similar uses, the importation of a total of fifty (50) meters is accepted.

Finally, with regard to carpets, a total of up to fifty (50) square meters may be imported.

CHAPTER 4- HOUSEHOLD APPLIANCES

The importation of household appliances has been a topic of interest for many travelers around the world, including those visiting Cuba. For this reason, Customs has established specific regulations to ensure proper importation of this equipment.

In accordance with the established regulations, Cuban Customs admits the importation of household appliances on condition that they are varied, that is, up to two (2) items of the same type, provided that the sum of their values does not exceed the limit established for the importation of baggage, shipments or any other operation to be carried out, as appropriate and in accordance with the provisions of Annex III.

In addition, for parts and accessories of household appliances, the value-weight alternative is used, as long as it is shown that there is diversity in the products. In other words, it must be demonstrated that different parts and accessories are being imported, and not simply several parts of the same type.

As for power plants, Cuban Customs allows the importation of up to two (2) such items, which means that travelers must take this limitation into account when planning their importation.

CHAPTER 5- COMPUTER AND COMMUNICATIONS EQUIPMENT

Customs allows the importation of up to three (3) devices related to telecommunications and networks, including computer equipment accessories and peripherals such as mice, keyboards, among others.

In the case of computer equipment, such as desktop microcomputers, laptops, tablets and digital reading devices, up to three (3) units are allowed, regardless of their type.

For flash memories, computer parts and components, mobile and fixed telephony devices, printers, photocopiers and other computer and communications equipment, the value-weight alternative is used, as long as there is diversity in the imported products.

As for cellular or smart phones, up to five (5) units are allowed.

CHAPTER 7- FURNITURE

Household articles classified as furniture are allowed to be imported, as long as their value does not exceed fifty (50.00) USD. Customs admits up to five (5) items of each type. In the case of furniture exceeding this value, including those constituting sets, up to three (3) items are allowed, in accordance with the import limit.

In the case of furniture or furniture sets that include beds or cribs, Customs allows the importation of their respective mattresses.

Likewise, up to three (3) units of each type of furniture for baby use, such as cribs, strollers, playpens, rocking chairs, walkers and the like, are allowed.

CHAPTER 8- MOTOR VEHICLES, THEIR PARTS, PARTS AND ACCESSORIES

Customs has certain rules regarding the importation of vehicles and their parts. In the case of electric mopeds up to two seats, up to two (2) items are allowed as baggage or one (1) through shipments.

As for motor vehicle parts and accessories, their importation is allowed provided that the specific legislation is respected and the quantity does not exceed what is necessary to repair and maintain a vehicle.

For "kits, kits or sets" of parts constituting a set, up to five (5) sets are allowed, provided that only one of each type is imported and the maximum number of units per set does not exceed that required to repair one vehicle. In the case of gaskets, up to two (2) sets of each type are allowed.

Regarding the valuation of the pieces, the value-weight alternative is applied to those weighing no more than five (5) kilograms, provided they are diverse. For heavier pieces, other valuation methods are applied, although Customs will evaluate whether it is necessary to weigh them or not if the person requests it.

The importation of tires and rims is limited to five (5) for light vehicles, seven (7) for heavy vehicles and three (3) for motorcycles or mopeds.

Finally, the importation of motor vehicles, vehicle engines and bodyworks is subject to the specific laws on the matter.

CHAPTER 9- TOYS AND SPORTING AND RECREATIONAL GOODS

Customs allows the importation of articles for fishing activities, including up to three (3) reels, spools or reels of fishing line and up to ten (10) kilograms of hooks, sinkers, lures and other similar items.

Regarding the importation of personal means of transportation, Customs admits up to two (2) items classified as bicycles, electric and pedal-assisted bicycles, electric skateboards or similar.

In the case of pneumatic weapons with projectiles of 4.5 mm or smaller and that comply with the legal requirements, the importation of one (1) is allowed only once and for a reference value of not less than 500.00 USD.

Regarding the importation of unmanned aircraft, parts and pieces, their entry through Customs is allowed with prior authorization from the Cuban aeronautical authority, in accordance with the provisions of the specific legislation in force.

CHAPTER 10- CONSTRUCTION MATERIALS

Customs allows the importation of materials classified as veneer and flooring pieces, with a maximum quantity of 50 m2, except in the case of flashings, borders and similar, which are admitted in the same quantity but their unit of measurement is the linear meter.

As for manufactured goods for use in construction, imports of up to 50 units are allowed, while for other hardware of any type and other construction materials, the quantity allowed is up to 10 units.

Imported products are valued using the reference value, declaration or purchase invoice methods, and up to two (2) of each type are accepted. Hand tools may be valued by the value-weight method if their weight does not exceed three (3) kilograms.

Tools intended for commercial, industrial or manufacturing activities are not allowed as non-commercial imports.

Rules for non-commercial imports by natural persons:

  1. The non-commercial importation of articles or products is allowed as long as they comply with customs regulations, do not indicate commercial purposes and the sum of their values does not exceed the limit established for the importation of baggage, shipments or other operations.
  2. In the event that the quantity of the same product indicates an obvious commercial purpose, the provisions of Annex III, paragraph 3 "Common Provisions for the determination of the commercial nature of non-commercial imports" shall apply.
  3. The customs authority has the authority to apply the value-weight method to those articles that due to their characteristics and value can be valued by this method, in accordance with the legislation in force. This method shall be applied to articles that do not classify as miscellaneous, provided that they are diverse and are applied to articles of domestic use, hardware, parts and pieces of household appliances, computer equipment, communications, musical instruments and parts and pieces of vehicles whose weight does not exceed five (5) kilograms.
  4. When an article or product is not defined in the reference values, Customs shall take as a basis the reference price available, including the sales price in domestic trade and in other origins, in accordance with the legislation in force.
  5. For household appliances, computer and communications equipment and other durable goods, the Customs declaration, the purchase invoice or the reference value shall be applied as the valuation method, without prejudice to the application of the provisions of a specific provision or that requested by the person, in which case Customs shall evaluate whether or not to weigh it.
  6. The Specific Rule of each Chapter (Annex III) prevails over the wording of the General Rule of this Annex for the analysis, valuation and definition of the commercial character or purpose of the imported articles or products.

Aspects to be taken into account for the classification of other articles or products that are not classified as miscellaneous

  1. The fundamental parts and pieces of machines, apparatus and equipment imported together are considered by customs as complete machines, apparatus and equipment. When they are presented in fractioned form, it is taken into account that the sum of the parts represents the total value of the equipment to be imported.

Examples: a) The importation of a tower and a monitor is admitted as the importation of a complete microcomputer. b) The importation of a bicycle without tires is considered as the importation of a complete bicycle.

  1. Multifunctional products are classified according to their main function, taking into account the composition of the product, the use or application of each function.

Examples: a) A television set with the digital TV decoder box attached is classified as a television set, as this is the essential function of the equipment. b) A fan with lamp included is classified as a ventilator.

  1. Parts, pieces and accessories of a machine, apparatus or equipment are considered to be those components that are specifically designed to integrate that machine, apparatus or equipment, even though they may be used in another way.

Examples: a) A refrigerator compressor is classified as "Climate and refrigeration equipment compressors". b) A PC source is classified as "Computer parts and accessories (Processors, RAM memories, CD or DVD reader or burner, mouse, keyboard, video cards, system cards and the like)".

  1. Household appliances, computer and communications equipment, apparatus or other articles that are not valued by weight are presented for customs clearance separately from the miscellaneous. When they are contained in the same baggage or shipment, the customs authority may apply the valuation by weight and deduct the corresponding value.

Example: A shipment containing an external disk and, in addition, miscellaneous items, the amount corresponding to the latter is deducted from the total weight and its value is considered without the need to open the package to separate the items.

COMMON PROVISIONS FOR THE DETERMINATION OF THE COMMERCIAL NATURE OF NON-COMMERCIAL IMPORTS

  1. In the case of miscellaneous articles, the importation of up to 5 kilograms of the article or product will be allowed if the quantities of the same article or product indicate the existence of an importation for commercial purposes. The remainder will be seized at the discretion of the customs authority. For example, if a passenger attempts to import 90 kilograms of women's shoes, even if it does not exceed the permitted import value, only up to 5 kilograms will be allowed and the rest will be seized because the customs authority determines that there is a commercial nature.
  2. If the customs authority appreciates an evident commercial character to other articles or products by excess of the quantities, the importation of up to 5 kilograms of the article or product will be allowed and the rest will be seized. If the weight of the article or product is negligible, Customs will only authorize the importation of 1 kilogram and will seize the rest. For example, if a person imports 20 basins of hand-washing water in his or her luggage, the customs authority will only allow a total of up to 5 kg and will seize the rest due to the high quantities of the same reference indicating a commercial purpose.
  3. If the customs authority appreciates a commercial character due to excess quantities in articles or products to which the valuation methods of the Customs Declaration, purchase invoice or reference value have been applied, the importation of up to 5 articles or products of each type with a value not exceeding USD 50.00 is allowed. For those exceeding that value, up to 3 articles or products are allowed and the excess is seized, except for household appliances, computer and communications equipment and others to which the specific rule of their respective chapters applies. For example, if a person intends to import 5 toilet bowls with a reference value of 55.00 USD each, the customs authority only authorizes 3 units and seizes the rest as provided in Annex III, numeral 4).

  20. I would like to know exactly because of the ambiguity of the information on the weight limit of luggage in national currency with which you can enter once a year (I mean 125 kgs). What I managed to understand is that for each kilogram is 10 CUP, so in general it is 1250 CUP to enter. So if I enter with a laptop I would be deducted from the 1250 CUP 250 CUP for values shown in the table so I would be left to import 1000 CUP that by mathematics I can get how many pounds I would be left to import. I would like to know if I'm right or if I'm wrong about something. Thanks in advance.
